Terms of Service

This is a starting-point template, not legal advice — have a Colorado-licensed attorney review it, particularly the liability, dispute-resolution, and dealer-licensing sections, before relying on it.
1. Acceptance
By creating an account on Auction Road (“the platform”), you agree to these Terms. If you don't agree, don't use the platform.
2. Eligibility
- You must be at least 21 years old and pass identity verification to bid or sell.
- You must provide accurate registration information (legal name, working email and phone).
- Auction Road is a Colorado business; by using the platform you agree Colorado law applies to transactions conducted through it, regardless of where you're located.
3. Auction Road is a marketplace, not the seller
Auction Road connects private buyers and sellers. We are not a party to any vehicle sale, we do not own the vehicles listed, and we do not inspect vehicles ourselves beyond the information and photos the seller provides. Each listing reflects the seller's own representations.
4. Vehicles are sold as-is
Unless a listing explicitly states otherwise, every vehicle is sold AS-IS, WHERE-IS, WITH ALL FAULTS, with no warranty of merchantability, fitness for a particular purpose, or any other warranty, express or implied. Buyers are responsible for reviewing listing photos, seller disclosures, damage diagrams, and any vehicle history report before bidding. Colorado's odometer disclosure and title-branding requirements still apply, and sellers are responsible for accurate title status disclosure.
5. Bidding is binding
A bid is a binding offer to purchase at that price if you are the winning bidder. Bids cannot be retracted except in cases of a clear, demonstrable listing error, at Auction Road's sole discretion. Your maximum bid can never exceed your wallet balance — top up before bidding higher.
Winning bidders are expected to complete payment through the platform's escrow process promptly. Failure to complete a winning purchase may result in account suspension and forfeiture of platform fees.
6. No sales on Sundays
Colorado law (C.R.S. § 44-20-302) prohibits the sale, barter, or exchange of a motor vehicle on a Sunday. Bidding is disabled platform-wide every Sunday, and any auction that would otherwise close on a Sunday automatically extends to the following Monday.
7. Fees and membership
Bidding and selling require an active annual membership: $200 the first year for individuals ($100/year to renew), or $300 the first year for licensed dealers ($200/year to renew). Sellers pay a 3% platform fee on the final hammer price, split between buyer and seller. Fees are disclosed before you commit to any paid action and are non-refundable once a service is rendered (e.g., a completed identity verification or a vehicle history report).
Winning a car requires at least half its price sitting in your Auction Road wallet at the time you bid. That half is deducted from your wallet the moment you win; the remaining half is paid separately through escrow before the title transfers.
8. Relisting cycle for unsold vehicles
If a listing gets zero bids through its full cycle (Weekly, then Daily, then its 3-hour Live close), it is automatically relisted once for a shorter 24-hour round. If that also gets zero bids, the listing goes dormant for 6 months. Updating the price, description, or photos at any point during that window relists it from the start of a full cycle. A dormant listing left untouched for the full 6 months is automatically removed.
9. Prohibited conduct
- Shill bidding, bid manipulation, or coordinating with other users to manipulate a price
- Creating multiple accounts to evade a suspension or bidding limits
- Listing a vehicle you don't own or aren't authorized to sell
- Misrepresenting a vehicle's condition, title status, or history
Violating any of these is grounds for immediate account suspension.
10. Limitation of liability
To the maximum extent permitted by Colorado law, Auction Road is not liable for any dispute between a buyer and seller, the condition of any vehicle sold through the platform, or indirect, incidental, or consequential damages arising from platform use. Our aggregate liability for any claim is limited to the fees you paid us in the twelve months before the claim arose.
11. Account termination
You can delete your account at any time from My Account. We may suspend or terminate accounts that violate these Terms, attempt fraud, or fail to complete a winning bid's purchase.
12. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute arising from these Terms or platform use will be resolved in the state or federal courts located in Colorado.
13. Changes to these terms
We may update these Terms as the platform evolves. Continued use after a change means you accept the updated Terms.
